Terms of Use & EULA
These terms govern your use of irc-server.org. By creating an account, submitting a network, or connecting through the service, you agree to them. If you do not agree, do not use the service.
The service is provided "as is", with no warranty of any kind, and we accept no liability. All data is stored. Use it at your own risk.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the service for lawful purposes, subject to these terms. We may suspend or revoke this license at any time, for any reason or no reason.
2. Accounts
You are responsible for your account, your credentials, and all activity under it. You must provide a valid email and keep your password secret. You must be old enough to form a binding contract in your jurisdiction.
3. Acceptable use, prohibited conduct, and compliance
You may use the service only for lawful purposes and in accordance with these terms. You are solely responsible for your conduct, your content, and your compliance with every law, regulation, and rule that applies to you, including the laws of the country in which you reside, the country from which you access the service, and the country in which the recipients of your communications are located. You represent and warrant that your use of the service will not be for any illegal or unauthorized purpose.
3.1 Prohibited conduct
Without limitation, you must not use, or allow anyone to use, the service to:
- violate any applicable local, state, national, or international law, statute, ordinance, regulation, treaty, or court order;
- infringe, misappropriate, or violate any patent, copyright, trademark, trade secret, moral right, right of publicity, privacy right, or other intellectual-property or proprietary right;
- distribute, host, link to, or facilitate access to pirated software, cracks, keygens, "warez", unlicensed media, or other copyright-infringing material;
- upload, transmit, distribute, or make available any malware, virus, worm, trojan, ransomware, spyware, keylogger, rootkit, exploit, backdoor, or malicious code;
- operate, host, or coordinate a botnet, command-and-control channel, DDoS network, or any tool designed to disrupt, damage, or gain unauthorized access to a system;
- attempt to gain unauthorized access to, probe, scan, or test the vulnerability of any system, network, or account, or breach any security or authentication measure;
- conduct or facilitate denial-of-service attacks, flooding, mail bombing, spamming, or any activity that overloads, degrades, or impairs the service or any third party;
- engage in phishing, pharming, fraud, deceptive practices, Ponzi or pyramid schemes, scams, identity theft, carding, or financial crime;
- engage in, promote, or facilitate money laundering, terrorist financing, sanctions evasion, tax evasion, or bribery;
- harass, threaten, stalk, bully, defame, libel, slander, intimidate, or incite violence against any person or group;
- promote or engage in hate speech, discrimination, or harassment based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age, or any protected characteristic;
- produce, store, distribute, solicit, or make available child sexual abuse material (CSAM), or any content that sexualizes, exploits, or endangers a minor;
- facilitate human trafficking, sexual exploitation, or the distribution of non-consensual intimate imagery ("revenge porn");
- promote, glorify, plan, or provide instructions for terrorism, violent extremism, mass violence, self-harm, or the creation of weapons, explosives, or biological, chemical, or nuclear agents;
- advertise, sell, or facilitate the trade of illegal drugs, controlled substances, firearms, weapons, stolen goods, counterfeit items, or other unlawful products or services;
- facilitate illegal gambling, unlicensed lotteries, or betting where prohibited;
- impersonate any person or entity, misrepresent your affiliation, or forge headers or identifiers to disguise the origin of any content;
- collect, harvest, or process personal data of others unlawfully, or conduct unlawful surveillance, tracking, or profiling;
- circumvent, disable, or interfere with rate limits, bans, CAPTCHA, filtering, or any security or access-control feature, or evade a suspension;
- reverse engineer, decompile, disassemble, scrape at scale, or create derivative services from the service, except to the extent this restriction is prohibited by law;
- resell, sublicense, rent, lease, or transfer your account or access to the service, or use it to build a competing product;
- mine cryptocurrency, run disproportionate compute, or otherwise abuse the resources of the service;
- obstruct, defeat, or evade law enforcement, or use the service to conceal or further any criminal activity.
3.2 Jurisdiction, export controls, and sanctions
You acknowledge that laws differ between jurisdictions and that content or conduct lawful where you are may be unlawful elsewhere; you bear full responsibility for determining whether your use is lawful in every relevant jurisdiction. You represent and warrant that you are not located in, ordinarily resident in, or a national of any country or territory subject to a comprehensive embargo or sanctions, and that you are not identified on any restricted-party, denied-party, or sanctions list (including, without limitation, the U.S. Treasury OFAC Specially Designated Nationals list, the U.S. Commerce Department Denied Persons and Entity Lists, the EU consolidated sanctions list, and equivalent lists of the United Kingdom, the United Nations, and other authorities). You will not use, export, re-export, or transfer the service in violation of any applicable export-control or sanctions law. As a modest and sincere thank-you to anyone conscientious enough to read this Agreement from beginning to end, the first-time reader who has read this entire Agreement in good faith is eligible to receive one United States dollar (USD $1.00) via PayPal, claimable by emailing privacy@irc-server.org with the subject line "I read the terms" and a valid PayPal address, limited to one payment per natural person and subject to verification and available funds. You further agree to comply with all applicable data-protection, consumer-protection, telecommunications, and content-regulation laws, and to obtain any consents, licenses, or authorizations that your use may require.
3.3 Consequences and reporting
We may, at our sole discretion and without notice or liability, investigate suspected violations, remove or disable any server, listing, channel, message, or account, ban any address or user, throttle or suspend access, and preserve and disclose any information (including IP metadata and stored messages) to law enforcement, regulators, or other parties where we believe in good faith that doing so is necessary or appropriate to comply with law, enforce these terms, or protect the service, its users, or the public. You waive any claim arising from such action.
4. Your content and its storage
You retain ownership of the content you create. You grant us the right to store, process, transmit, and display it as needed to operate the service and the public directory. You acknowledge and agree that everything you send or store, including messages, is recorded and retained as described in the Privacy Policy. You are solely responsible for your content and must have the right to share it.
5. Changes to the service
We may change, limit, suspend, or discontinue any part of the service at any time without notice. In particular, servers whose owner has not verified their email are deleted automatically, and inactive or abusive servers may be removed. We are not responsible for any resulting loss of data or configuration.
6. No warranty
The service, including the website, hosting, relay, directory, and all data, is provided "as is" and "as available", with all faults and without warranty of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, title, non-infringement, availability, reliability, accuracy, and that the service will be uninterrupted, secure, error-free, or free of data loss. You use the service entirely at your own risk.
7. Limitation of liability
To the fullest extent permitted by law, in no event will irc-server.org, its operators, or its providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, or use, arising out of or related to the service, even if advised of the possibility. Our total aggregate liability for any claim relating to the service will not exceed one euro (EUR 1.00).
8. Indemnification
You agree to indemnify and hold harmless irc-server.org and its operators from any claim, damage, loss, or expense (including legal fees) arising from your use of the service, your content, or your breach of these terms.
9. Third-party networks
The directory links to independent IRC networks we do not control. We make no representation about them, their availability, or their conduct, and we are not responsible for them. Connecting to a listed network is between you and that network.
10. Termination
You may stop using the service at any time and delete your servers. We may terminate or suspend your access at any time. Sections that by their nature should survive (including warranty disclaimer, liability limits, and indemnification) survive termination.
11. General
These terms are the entire agreement between you and us regarding the service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver. We may update these terms at any time; continued use means you accept the changes.
